Returns & Refunds Policy

At Marian Clothing, we want you to be happy with your purchase. This Returns & Refunds Policy explains when products may be returned, exchanged or refunded.
This policy applies to purchases made through the Marian Clothing website and is subject to applicable South African consumer protection laws, including the Consumer Protection Act 68 of 2008 (CPA).
Nothing in this policy is intended to limit any rights you may have under applicable law.
1. Ready-to-Wear Products
Ready-to-wear products may be eligible for a return or exchange where permitted by law and where the product meets the applicable return conditions.
Items returned for a change of mind should be:
Unworn
Unwashed
Unaltered
In their original condition
Returned with original tags and packaging where applicable
Free from makeup, perfume, stains, pet hair or other marks
We reserve the right to assess the condition of returned items before approving a return or exchange.
2. Custom, Made-to-Measure and Personalised Garments
Custom-designed, made-to-measure and personalised garments are created specifically according to the customer’s requirements.
Because these garments are made specifically for an individual customer, change-of-mind returns or exchanges may not be available once production has started, except where required by applicable law.
This may include:
Custom dresses
Custom bridal gowns
Custom bridal robes
Bridal pyjamas made to specific requirements
Made-to-measure garments
Personalised garments
Garments produced using customer-selected fabrics, colours or design specifications
Customers are therefore encouraged to carefully confirm measurements, design details, colours, fabrics and other specifications before production begins.
3. Incorrect Measurements
Where a customer provides their own measurements for a made-to-measure garment, the customer is responsible for ensuring that the measurements supplied are accurate.
If a garment does not fit because incorrect measurements were provided by the customer, the garment may not qualify for a refund or free remake.
Where possible, Marian Clothing may offer alterations at an additional cost.
Where Marian Clothing took the measurements and the garment does not correspond reasonably with the agreed measurements, please contact us so that we can assess the matter.
4. Defective or Faulty Products
If a product is defective or damaged, please contact us as soon as reasonably possible after discovering the issue.
Depending on the circumstances and applicable law, we may offer:
Repair
Replacement
Refund
Another appropriate remedy
The appropriate remedy will depend on the nature and circumstances of the problem and applicable consumer protection laws.
5. Incorrect Item Received
If you receive an item that is different from the item you ordered, please contact Marian Clothing as soon as possible.
Please provide:
Your order number
A description of the issue
Photographs of the item received
Photographs of the packaging where relevant
We will review the issue and, where appropriate, arrange a replacement, return or refund.
6. Damaged Items
Please inspect your order when it arrives.
If your item appears to have been damaged during delivery, please take photographs of the packaging and the item and contact us as soon as possible.
We may need to work with the courier service to investigate the damage.
7. Change-of-Mind Returns
Where a change-of-mind return is legally permitted or otherwise accepted by Marian Clothing, the item must be returned in its original condition and meet the applicable return requirements.
Change-of-mind returns do not generally apply to custom-made, personalised or made-to-measure garments once production has commenced, subject to applicable law.
8. Sale and Promotional Items
Final Sale Items
Items clearly marked as “Final Sale” or “No Returns/Exchanges” at the time of purchase are not eligible for change-of-mind returns or exchanges, except where a return, replacement, repair or refund is required by applicable South African consumer law. This does not affect your rights where an item is defective, damaged, incorrect or otherwise does not meet the requirements of applicable law.
However, purchasing an item on sale does not remove any consumer rights that cannot lawfully be excluded under South African law, including rights relating to defective or unsafe products.
9. Return Request Process
Before sending an item back, please contact us first.

We will provide instructions on the next steps.
Please do not send an item back without first contacting us, as this may delay the processing of your return.
10. Return Shipping
Where the return is due to a customer changing their mind and the return is permitted, the customer may be responsible for the return delivery costs.
Where the return is due to an incorrect item supplied, a qualifying defect or another issue for which Marian Clothing is responsible, the applicable return or delivery costs will be handled in accordance with applicable law and the circumstances of the case.
11. Refunds
Once a returned product has been received and assessed, we will notify you whether the return has been approved.
Where a refund is approved, the refund will generally be made using the original payment method where reasonably possible.
Processing times may vary depending on the payment method and financial institution.
Marian Clothing cannot control the processing time of a customer’s bank or third-party payment provider.
12. Refunds for Direct Bank Transfer Orders
Where an order was originally paid by direct bank transfer, Marian Clothing may request the customer’s banking details where necessary to process an approved refund.
Customers should ensure that the banking information supplied for a refund is accurate.
Marian Clothing will not be responsible for delays or losses caused by incorrect banking details supplied by the customer.
13. Custom Order Deposits
Where a deposit has been paid towards a custom, made-to-order or personalised garment, the treatment of the deposit will depend on the circumstances of the cancellation and applicable law.
If production has already started, costs may have been incurred for fabric, labour, design, preparation or other materials.
Any refund or amount retained will be handled in accordance with the agreed order terms and applicable South African law.
14. Order Cancellation Before Production
If you need to cancel a custom order, please contact Marian Clothing as soon as possible.
Where production has not yet started, we will assess whether the order can be cancelled and whether a refund is applicable.
Once materials have been purchased or production has started, cancellation may be subject to additional conditions.
15. Exchanges
Where an exchange is permitted, the replacement item will be subject to availability.
If the requested replacement is unavailable, Marian Clothing may offer another appropriate remedy where applicable.
Custom-made and personalised garments are generally not eligible for exchanges simply because the customer has changed their mind once production has started, subject to applicable law.
16. Hygiene and Worn Garments
For hygiene and quality-control reasons, garments that have been worn, washed, altered, damaged or otherwise used do not qualify for a change-of-mind return.
This does not affect your legal rights relating to defective or faulty products.
17. Event and Bridal Orders
Customers ordering bridal gowns, bridesmaid dresses, robes, party dresses or other garments for a specific event should place orders sufficiently in advance.
Because these garments may require design, production, fittings and alterations, customers are responsible for allowing sufficient time before their event.
Where possible, customers should provide their required event date when requesting a quotation or placing an order.
18. Consumer Rights
Marian Clothing respects the rights provided to consumers under applicable South African legislation.
Nothing in this policy is intended to:
Exclude rights that cannot legally be excluded
Prevent a customer from exercising a legal right
Limit remedies available to a consumer under applicable law
Where there is a conflict between this policy and a mandatory legal consumer right, the applicable law will prevail.
