Welcome to Marian Clothing. These Terms & Conditions govern your use of our website and your purchase of products and services from Marian Clothing.
By accessing our website, placing an order, requesting a custom design or using our services, you agree to be bound by these Terms & Conditions.
If you do not agree with these terms, please do not use our website or purchase our products and services.
1. About Marian Clothing
Marian Clothing is a fashion design and clothing business offering ready-to-wear and custom-designed garments, including dresses, bridal gowns and robes, bridal pyjamas, traditional clothing, children’s party dresses and other fashion-related products and services.
2. Use of Our Website
You agree to use the Marian Clothing website lawfully and responsibly.
You must not:
Use the website for fraudulent or unlawful purposes
Attempt to gain unauthorised access to the website or its systems
Interfere with the security or operation of the website
Copy, reproduce or use our website content without permission
Submit false, misleading or fraudulent information
Use another person’s account or personal information without authorisation
We reserve the right to restrict or terminate access to the website where we reasonably believe these Terms & Conditions have been violated.
3. Product Information
We make reasonable efforts to ensure that product descriptions, images, prices and other information displayed on our website are accurate.
However:
Colours may appear slightly different depending on your screen or device.
Fabric patterns and placement may vary from product photographs.
Handmade or custom garments may have minor differences from displayed images.
Product availability may change without notice.
We reserve the right to correct errors or update product information where necessary.
4. Prices
All prices displayed on the website are in South African Rand (ZAR) unless otherwise stated.
Prices may change from time to time. However, changes will not affect an order that has already been confirmed and paid for, except where an obvious pricing error has occurred.
Shipping charges, where applicable, may be added separately and will be displayed during checkout.
5. Orders
When you place an order through our website, you are making a request to purchase the selected products.
An order is considered accepted once Marian Clothing has confirmed the order and payment has been successfully received, subject to product availability.
We reserve the right to refuse or cancel an order where reasonably necessary, including in circumstances involving:
Incorrect pricing or product information
Product unavailability
Suspected fraudulent activity
Payment problems
Incorrect customer information
Circumstances outside our reasonable control
If we cancel an order that has already been paid for, we will arrange an appropriate refund where applicable.
6. Payment
Payment must be made using one of the payment methods made available at checkout.
Depending on the payment options available, these may include:
Direct bank transfer
Online payment through an approved payment provider
Other payment methods made available by Marian Clothing
For direct bank transfers, an order may only be processed once payment has been received and verified.
Customers should use the correct order number or payment reference when making a bank transfer.
7. Custom Designs and Made-to-Measure Garments
Custom-designed and made-to-measure garments are created according to information, measurements, preferences and specifications provided by the customer.
Customers are responsible for providing accurate information and measurements where required.
Because custom garments are made specifically for an individual customer, they may differ slightly from reference images or examples.
Design details, fabric availability, colour, embellishments and other elements may be discussed and agreed upon before production.
Once production has started, significant changes to the agreed design may not be possible or may result in additional costs.
8. Measurements and Fittings
Customers are responsible for providing accurate measurements when measurements are requested remotely.
Where Marian Clothing provides measurement or fitting assistance, customers should follow the instructions provided.
If inaccurate measurements are supplied by the customer, Marian Clothing cannot guarantee that the finished garment will fit as expected.
Where appropriate, additional alteration or adjustment charges may apply.
9. Bridal and Event Orders
Customers ordering bridal gowns, bridesmaid dresses, robes, party dresses or other event garments should place their orders sufficiently in advance of the required event date.
Production, fittings, alterations and delivery may require additional time.
We will make reasonable efforts to meet agreed timelines, but we cannot guarantee a particular event date where the order is placed too close to the event or where delays arise outside our reasonable control.
Customers are encouraged to communicate their required event date when requesting a quotation or placing a custom order.
10. Deposits and Custom Orders
Where a deposit is required for a custom or made-to-order garment, production may only begin once the required deposit has been received.
The applicable deposit amount, balance and payment deadlines will be communicated to the customer before production begins.
Custom orders may not be released or delivered until the required balance has been paid in full, unless otherwise agreed in writing.
11. Changes to Custom Orders
Once production has started, changes to a custom order may not always be possible.
If a change is possible, additional fabric, labour, alteration or other costs may apply.
Customers should carefully review and confirm design specifications before production begins.
12. Cancellations
Cancellation terms may depend on whether an order is:
A ready-to-wear product
A made-to-order product
A custom-designed garment
A personalised garment
A bridal or event garment
Customised, personalised and made-to-measure orders may not be eligible for cancellation once production has started, except where required by applicable law.

13. Returns, Exchanges and Refunds
Returns, exchanges and refunds are handled in accordance with our Returns & Refunds Policy and applicable South African consumer protection laws.
Customers should review the Returns & Refunds Policy before placing an order.
Custom-made, personalised and made-to-measure garments may be subject to different return or cancellation conditions, subject to applicable law.
14. Shipping and Delivery
Shipping and delivery are subject to our Shipping & Delivery Policy.
We currently offer delivery within South Africa using third-party courier services.
Delivery timeframes are estimates and may be affected by courier delays, public holidays, weather, incorrect delivery information and other circumstances outside our reasonable control.
15. Intellectual Property
All content on the Marian Clothing website, including but not limited to:
Logos
Brand names
Photographs
Product images
Graphics
Text
Designs
Website layouts
Original written content
is owned by or licensed to Marian Clothing unless otherwise stated.
You may not reproduce, distribute, modify, copy, sell or commercially exploit our content without prior written permission.
16. Customer-Supplied Images and Designs
Customers may provide reference images, sketches or design ideas when requesting a custom garment.
By submitting such material, you confirm that you have the right to provide it for this purpose.
Customer-supplied reference material will be used only as reasonably necessary to understand and create the requested design.
Marian Clothing does not guarantee that a custom garment will be an exact reproduction of a reference image, particularly where the image belongs to another designer or brand.
17. Photographs of Finished Garments
With appropriate permission, Marian Clothing may photograph finished garments for portfolio, website or marketing purposes.
We will not knowingly publish identifiable photographs of customers without appropriate permission.
If you do not want your garment or photograph used for marketing purposes, please let us know.
18. Third-Party Services
Our website may use third-party services, including payment processors, courier companies, hosting providers, booking systems and other service providers.
Your use of such services may also be subject to the third party’s own terms and policies.
Marian Clothing is not responsible for the independent actions, policies or systems of third-party service providers.
19. Website Availability
We make reasonable efforts to keep our website available and functioning properly.
However, we do not guarantee that the website will always be:
Available without interruption
Free from errors
Free from viruses or other harmful components
Compatible with every device or browser

Marian Clothing will not be responsible for delays or failure to perform its obligations where caused by circumstances reasonably beyond our control.

Transport disruptions
Courier delays
Government restrictions

Supplier delays
Other unforeseen circumstances
Where reasonably possible, we will communicate significant delays to affected customers.
